What the HUH?

The 5-4 ruling comes in the case of Genovevo Salinas, who was convicted of a 1992 murder. During police questioning, and before he was arrested or read his Miranda rights, Salinas answered some questions but did not answer when asked if a shotgun he had access to would match up with the murder weapon.

Prosecutors in Texas used his silence on that question in convicting him of murder, saying it helped demonstrate his guilt. Salinas appealed, saying his Fifth Amendment rights to stay silent should have kept lawyers from using his silence against him in court. Texas courts disagreed, saying pre-Miranda silence is not protected by the Constitution.

The high court upheld that decision.

I like where this is going. Our genuine issues and concerns will be more readily addressed, I think, if we can stand down from the #hyperrealism  that two entire generations of humans have been indoctrinated into. It won't be an easy, smooth, or clean process, but it's going to happen one way or another. The pendulum has to swing back.

Wayward

Despite my relative (ostensible) obedience, "wayward" is a word I'd readily use to describe myself in a lot of ways. It fascinates (and more subjectively and personally infuriates) me that as a species we can be absolutely aware of the moments immediately before and after making a grievously bad decision and yet we fully and consciously embrace that bad decision in the very moment of its execution. Our mind's ability to sequester itself is, I think, truly phenomenal. 

Recently, I did something monumentally foolish. There were costs, much higher than expected, but also easily recovered once my recidivism was put in check. That story isn't half as interesting as my grand vocabulary wants to make you believe. But tell me, instead, why do you do the things you know you shouldn't?

That would be the title of my There and Back Again I think. I like what I'm doing now, but I don't think it's a Forever-home. Since I left the world of celebrity and pastry, of my own willful accord mind you, it's been a trail of those moments. Occasionally I think I'd like to go back, most often when I thumb through a trade magazine. Just now I had what I think is a much healthier thought as I looked at photos of "world class" cuisine (the kind arranged with tongs) and gerbet macaroons - I can already do that, there's no reason to go back to it. Now what?

I know, I know, it's Jezebel. But still, this is a pretty accessible read and manages to tie in all the things I love - race, gender, body politics, media, and power.  Oh, and terrible image manipulation.

This is a Blackberry Mint Julep, and today I don't have cancer.

It turns out I have a scarred lymph node from a viral infection - a meaningless lump. I am lucky. My friend Brett has two friends who might have had cancer. One of them does. I don't feel guilty, but it's a weird thing to process.

Now, about that cocktail. I love whiskey. I love blackberries. They come from the same places in the Americas, so it stands to culinary wisdom that they can work together. This is the classic Mint Julep recipe with a simple twist, gone Northwoods. I added two fresh berries to the muddle and used Port 57 blackberry whiskey. It's awesome, and it's hot as hell here. The only tips I have: metal cups are stupid and for snotty showoffs or people who like wet hands. If the outside of your drink is frosty, the inside is less so. The most offensive thing I've heard today...

This is arguably the most adorable commercial I've seen in a while. Evidently, however, some people are offended by it. My solution? Make sure everyone sees it. If this offends you, I hope you watch it until you figure which part of you is twisted and can put it back to rights. The commercial's not offensive, but your perspective just might be.

On behalf of a grateful nation...

Like many people in this area, I drive directly past Arlington National Cemetery every single day on my way to work. It's easy to become numb to a great many of the things in DC, spectacles, people, and monuments, but I think this one stays just slightly fresh for everyone. It certainly does for me, anyway. It probably helps that I drive past it on an empty road, before dawn, or just at dawn, often before the night's fog has lifted. It probably helps that I have walked its paths, and that I have known in flesh some whose names are carved in its innumerable standing stone tributes. 

As I do every year, though to a much broader audience now than ever before, I humbly and respectfully ask that you take just a moment to remember that it's not National Cookout Day or the Annual Poolside Festival. Tomorrow is Memorial Day. It's a dayf... more »

American Gods was a great read, though perhaps tried a bit too hard in some spots. I was very pleased with some of the asides while others were entirely forgettable. The ending was worthy, though I was worried it wouldn't be addressed.

This is a very sensitive subject, and so while I'd rather not, I feel the need to preface this with a few things:

1)  I am asking this in a completely open way, hoping for genuine discourse, even though I obviously do have a strong opinion of my own. (For the record, this is always the way in which I ask questions.)
