We will work our way around this charming old west styled area for a for a couple of hours. I would share it once a month with everyone as a part of my personal desire to share more quality B&W images and photographers. Net Neutrality

I don't have a pretty link, so bear with me.

Net neutrality - all internet traffic treated equally - is essential to us as a free and open society.  A truly open internet means any idea, however right or wrong by 'societal' or corporate standards that idea may be.

Of course, there are problems with that.  Dealing with kiddie pr0n for example.  Some rules need to be established, but politically speaking everyone should be able to have their say.  It's hard to admit but even ISIS.

So the current talk is about bringing ISPs under Title II of the Telecommunications act (as amended in 1996).  There are good things, and bad things, and all must be considered.

So, I'm having a fire sale of sorts.  Many shits have hit the fan all of a sudden and I've got to throw this out there before I either lose my head or start finding things to list on eBay.

Net neutrality - all internet traffic treated equally - is essential to us as a free and open society.  A truly open internet means any idea, however right or wrong by 'societal' or corporate standards that idea may be.

Of course, there are problems with that.  Dealing with kiddie pr0n for example.  Some rules need to be established, but politically speaking everyone should be able to have their say.  It's hard to admit but even ISIS.

So the current talk is about bringing ISPs under Title II of the Telecommunications act (as amended in 1996).  There are good things, and bad things, and all must be considered.

Before I start, I have to say that it's a bad idea, but may be a poison pill I have to swallow.  Best would be Congress actually doing their job (I'll outline below) and worst would be status quo.

So I'll start on a positive note.  Why should we consider bringing ISPs under common carrier (Title II)?  The answer there is pretty simple - The FCC would be able to enact the fairness rules that were struck down by the courts on the grounds that the ISPs weren't common carriers by current definition and therefore the FCC had no right.  It would also eliminate the owners of the 'last mile' (from the nearest backbone connection to your house) from interfering with internet traffic, whether from their network, or companies that they're required to lease their lines to.

Which sounds great - and it is - but there are problems (which I'll get to in a bit)

"Common Carrier" (that term that's being bandied about lately) in most of the world means goods transportation - the intent is that someone like, say United Trucking, can pick up a truckload of crap from your house or business, take it to a train station, load the box of crap on board, and pick it up at the other end for delivery - or contract with someone else to pick it up at the far end.  This is a really important concept for freight since there's a de facto monopoly, particularly on the Left Coast on rail freight.  UP is the schnizit other than a couple of local runs like to the Port of Long Beach.  Common carrier also applies to things like natural gas and oil where it makes sense to allow one easement and make everyone share it.

That sounds good right?  On the surface it makes perfect sense.  And our benevolent overlords like Google and Netflix (who ended up prostrating themselves before Comcast last year) love it because it sounds great to the average Joe and guarantees parity on the market.

But here's the problem with bringing ISPs under Title II.  Actually there are several but I'll pare it down a bit.

First of all, and most importantly, Title II will absolutely kill innovation.  Every instance I can think of, Title II requires that whatever service provider allow equal access to their equipment at a reasonable cost.  Again, sounds good, at least on the surface, right?  Well, there are two problems here.  One, it absolutely stifles innovation, and two, it doesn't address content.

Innovation is stifled because everyone is placated because they think they have a choice in ISPs, when in reality it means they can subscribe to a service that leases bandwidth from the owner of the lines at wholesale rates.  Effectively the line-owner (let's say Comcast) has a win-win because no matter who is the "ISP" they still get a cut because they put the lines in.

It's important to note at this point that especially if you live in a city, the easements given to whatever are granted on an exclusive basis.  So even if your cable company strings their wires on poles owned by the power company, they have exclusive rights to provide that sort of service on that pole.  The only real change was in 1996 where your phone company could also provide similar services (but they were also already on that pole).

So in cities, especially, there is codified in contract a pre-existing number of companies that have access to that pole (or trench) running past your house.  Classifying ISPs  under Title II will do nothing to change that.  In fact, it would generally have the opposite effect since Joe's Cable Company could just lease the lines Comcast already owns.

And I know some are asking "what's the big deal? They built it?" and the answer there is that a contract was made - in many cases 30 years ago - to put up wires in return for exclusivity.  Except that 30 years later most cities aren't requiring to even share those lines (on public property and/or easements taken from property owners) with anyone else.  So the big deal here is that easements are semi-public property, and the government is limiting use of the land they've taken from the owner for private, exclusive contracts.  Someone couldn't walk in and say "I have $100M and would like to provide a better service". Note the only places where Google Fiber is being run are cities that have gotten rid of this agreement.

So what's the best answer?
One, local communities have to end their agreements the moment the contract is up, rather than just let it be de rigeur.  On a federal level, there needs to be rules where once those contracts are expired the marketplace needs to be open (note, I am not saying the gov't should nullify contract law because that's just a horrible precedent).

Two, as an addendum to one, easements need to be open to anyone that has a solid business plan and funding to cover even if they fail while they have holes in the ground.  Case in point, my neighborhood has fiber because 12 years ago someone thought that was a good idea, and though they didn't survive the dotcom crash they had funding in place to ensure there weren't big holes in the ground.  

Three, real competition and actual net neutrality rules need to come to the fore.  3a, if your ISP can't handle the bandwidth of Netflix, they should upgrade because that's just the internet.  3b if your ISP can't handle Netflix, you should be able to switch to someone who can.

Four, "common carrier" works for goods, where the infrastructure is well established and anything other than incremental increases in efficiency are unlikely.  On the internet, common carrier makes a lot less sense because there's zero reason for a carrier to increase efficiency.

On a side note, Title III - the bit that allows content carriers to acquire content creators is probably the worst part of the '96 communications act, and may well be one of the worst (intentional or not) attacks on free speech since We As The People first spoke out.

*TL;DR* Title II is bad but may be our only choice at this point since both Ds and Rs have ignored the public polls.  There are other solutions but they require Congress to actually do something for the public (rather than their own) good.  Title II will kill any hope in catching up with the developed nations' so far as speed and service goes, but it may be our only hope at this point for at least maintaining some modicum of free speech.

It's a bitter pill but I may have to swallow it :/___

I'm gearing up for listing a stack of junk on eBay but thought I'd throw some of the art stuff out here in case anyone's interested.  

So what you get here:
A back-signed 5th-grade quality original watercolor paired with a print from the projection session I used it in.  This is truly "one of a kind" in any sense of the words.  Both are matted and ready to go into 12"x16" identical frames if you can find some that simultaneously don't clash with both the "art" and your decor.  Simple black from a 'buy one, get one for a penny" from Aaron Brothers is probably best (they're actually not bad frames) or I can point you to the ones I get from Amazon.  Oh, and the print is a nice metallic to make sure your guests' eyes are drawn to it in, er, amazement (or something like that).... more »

I try not to ask for much, but too many shits have hit the fan and I've got to throw this out there before I either lose my head or start finding things to list on eBay.

So here's the deal.  I can't accept money.  I'm extremely uncomfortable with that unless I can give something return. To that end, I mentioned the gplusrocks coupon the other day, and I'm letting that stand.  That means 8x10 prints are about $25 signed and matted.  All other sizes and mountings are similarly marked down too.  But give me an offer.  If there's something you like in a size/form you like let me know and I'll work with you to make it happen so long an I'm not losing money :P  I'll also be offering some combinations of prints and the watercolors (like this one) that I used to make them in the next few days so watch for them too.

I think there's something in there for everyone, so have a browse, and please do tell your friends if you like my works and think they may as well.
